1. Acceptance of Terms
By accessing, ordering, installing, or utilizing the self-service hardware terminals, Kitchen Display Systems (KDS), Customer Display Systems (CDS), or integrated software packages provided by Nexus Kiosk ("we", "us", or "our"), you ("Client", "User", or "you") agree to be bound by these Terms of Service. If you do not agree, you must cease all utilization of our products immediately.
2. Scope of Service & Hardware Supply
Nexus Kiosk supplies commercial self-ordering hardware configurations (including Floor Stand, Wall Mount, and Countertop systems) along with integrated operational software platforms. Hardware specifications are provided at the time of purchase. All hardware purchase plans include our standard manufacturer support guarantee unless customized service plans are selected.
3. Software Licensing & Support
All software integrations, Cloud Dashboards, and KDS/CDS control applications are licensed—not sold—to you for the duration of your active subscription plan. Licenses are non-exclusive, non-transferable, and fully revocable upon termination of subscription. Software modifications, reverse-engineering, or unauthorized redistribution of our platform is strictly prohibited.
4. Subscriptions, Payments & Billing
Clients agree to pay all applicable hardware setup fees, implementation charges, and recurring software subscription fees. Subscriptions are billed in advance on a monthly or annual basis. Failure to complete recurring payments within 14 business days of the invoice date may result in immediate suspension of active cloud software services and transaction processing routes.
5. Data Privacy & Customer Information
Your utilization of our systems is also governed by our Privacy Policy. By deploying our checkout terminals, you acknowledge that you are the Data Controller of customer order and payment data, and Nexus Kiosk acts as the Data Processor. It is your sole responsibility to comply with local merchant data protection acts.
6. Limitation of Liability
In no event shall Nexus Kiosk, its officers, or associates be liable for any indirect, incidental, special, or consequential damages (including loss of profits, transactions, or business operational time) arising from terminal downtime, network outages, or software processing interruptions. Our total liability under any claim shall not exceed the subscription fees paid by you in the 3 months preceding the event.
7. Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with local commercial regulations. Any disputes arising out of your utilization of our self-service kiosk ecosystems shall be subject to the exclusive jurisdiction of the regional courts.
